1. Acceptance of Terms

Welcome to BotCollector. These Terms of Service ("Terms") govern your access to and use of the BotCollector website, applications, and services (collectively, the "Service"), operated by BotCollector, a sole proprietorship based in Georgia, USA ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years old to use our Service. By creating an account, you confirm that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2.2 Account Responsibility

If you create an account on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and the entity.

3. Account Terms

3.1 Account Creation

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Security

You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account. We recommend using a strong, unique password and enabling any additional security features we offer.

3.3 One Account Per Person

Each person may maintain only one account. Creating multiple accounts to circumvent restrictions, abuse promotions, or for any deceptive purpose is prohibited and may result in termination of all accounts.

4. Subscriptions & Billing

4.1 Subscription Tiers

BotCollector offers the following subscription tiers:

• Free - Basic collection tracking with ads
• Premium - Ad-free experience with image uploads (up to 100 images)
• Pro - Unlimited everything for power collectors

Current pricing is available on our Pricing page. We reserve the right to change pricing with 30 days' notice to existing subscribers.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the billing cycle you select. Payment is processed through Stripe, and you agree to their terms of service.

4.3 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for the renewal amount.

You can cancel auto-renewal at any time through your account settings. After cancellation, you will retain access to paid features until the end of your current billing period.

4.4 Refund Policy

Our refund policy is as follows:

• Monthly subscriptions: No refunds. You may cancel at any time, and you will retain access until the end of your billing period.
• Annual subscriptions: Pro-rata refund available within the first 14 days if the service is unused, minus any payment processing fees. After 14 days, no refunds are available, but you may cancel to prevent renewal.

EU consumers have additional rights under applicable consumer protection laws. If you believe you are entitled to a refund under EU law, please contact us.

4.5 Downgrading

If you downgrade from a paid tier to Free, or from Pro to Premium:

• Your existing data (collections, images, notes) will be preserved
• You will no longer be able to upload additional images beyond your new tier's limit
• You may see advertisements on the free tier
• You can delete images at any time regardless of tier

4.6 Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment cannot be processed after multiple attempts, your subscription may be downgraded to the free tier. We will notify you before any downgrade occurs.

5. Acceptable Use

You agree not to use the Service to:

5.1 Prohibited Content

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload sexually explicit content, including nudity
• Upload content depicting violence, gore, or cruelty
• Upload content that infringes on intellectual property rights
• Upload personal information of others without their consent
• Upload malware, viruses, or other harmful code

5.2 Prohibited Activities

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scrapers) to access the Service without permission
• Circumvent any security features or access controls
• Engage in any activity that could harm or exploit minors
• Use the Service for spam, phishing, or fraudulent purposes
• Resell or redistribute access to the Service

5.3 Enforcement

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including removing content, suspending accounts, and reporting to law enforcement if necessary.

6. User Content

6.1 Ownership

You retain all ownership rights in the content you upload to the Service ("User Content"), including images, reviews, notes, and other materials. We do not claim ownership of your User Content.

6.2 License to BotCollector

By uploading User Content, you grant BotCollector a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of operating and providing the Service. This license includes:

• Storing your content on our servers and backup systems
• Displaying your content to you within your account
• Processing images for optimization (resizing, format conversion)
• Displaying public content (reviews, public images) to other users

6.3 Public Image Sharing

If you opt in to share images publicly, you grant us an additional license to display those images on figure detail pages to help other collectors. When your images are used in this way:

• You will be credited as the contributor
• Other users can view but not download full-resolution versions
• You can withdraw this consent at any time through your settings
• Upon withdrawal, we will remove your images from figure pages within a reasonable time

Important: We will never use your images for promotional or marketing materials without separate, explicit consent.

6.4 Content Moderation

All uploaded images are automatically scanned for inappropriate content using AI-powered moderation. We reserve the right to:

• Reject uploads that violate our content policies
• Remove content that is later found to violate our policies
• Suspend or terminate accounts for repeated violations

6.5 Responsibility for Content

You are solely responsible for your User Content and the consequences of uploading it. We do not endorse any User Content and are not liable for any content uploaded by users.

6.6 Image Rights Warranty

By uploading images to the Service, you represent and warrant that:

• The images are your own original photographs of figures you own or have physical access to, or
• You have obtained the necessary rights, licenses, or permissions to use and upload the images
• The images do not infringe any third-party copyright, trademark, or other intellectual property rights
• The images do not contain watermarks, logos, or branding from other websites, publications, or photographers without their permission

Official promotional images from toy manufacturers may be used for identification purposes in accordance with fair use principles. However, you are responsible for ensuring your use is appropriate, and BotCollector reserves the right to remove any image at its sole discretion.

If you believe an image on our platform infringes your rights, please see our DMCA process in Section 7.3.

7. Intellectual Property

7.1 BotCollector Platform

The Service, including its design, features, code, and original content (excluding User Content), is owned by BotCollector and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without permission.

7.2 Third-Party Trademarks

All product names, figure names, logos, images, and related content in our database are trademarks and copyrights of their respective owners, including but not limited to Hasbro, Takara Tomy, Bandai, 52Toys, Good Smile Company, Mattel, NECA, Super7, and other manufacturers worldwide. BotCollector is not affiliated with, endorsed by, or sponsored by any toy manufacturer, licensor, or trademark holder.

The use of third-party product names, trademarks, and related imagery on this platform is solely for the purpose of identification, commentary, and informational reference to help collectors catalog and manage their collections. Such use constitutes nominative fair use and does not imply any affiliation, endorsement, or sponsorship. We do not sell action figures, toys, or any physical products.

Because our platform allows user-contributed figure entries, our database may include references to products from any manufacturer. The inclusion of any product in our database does not imply any relationship with the manufacturer or rights holder.

7.3 DMCA and Copyright Claims

We respect intellectual property rights and respond to valid copyright infringement notices. If you believe content on our Service infringes your copyright, please send a DMCA notice to privacy@botcollector.app including:

• Identification of the copyrighted work
• Identification of the allegedly infringing material and its location
• Your contact information
• A statement of good faith belief that use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

8. AI Features

8.1 Figure Identification

Our Service includes AI-powered figure identification that can analyze images you upload to help identify action figures. When you use this feature:

• Your image is sent to Google Cloud Vision for analysis
• The image is processed in real-time and not stored by Google
• Results are provided for informational purposes only

8.2 Accuracy Disclaimer

AI identification results are not guaranteed to be accurate. The technology may incorrectly identify figures, especially for rare, custom, or modified items. Always verify identifications independently before making purchasing or valuation decisions.

9. Community Forums

When our community forums become available, the following additional terms will apply:

9.1 Community Guidelines

• Be respectful and civil in all interactions
• Stay on topic and contribute constructively
• No harassment, bullying, or personal attacks
• No spam, self-promotion, or commercial advertising
• No disclosure of others' personal information

9.2 Moderation

Forums are moderated by BotCollector staff. We may edit, move, or remove posts that violate guidelines, and may suspend forum access for repeat offenders.

10. Disclaimers

10.1 "As-Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantees

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors will be corrected
• The Service will meet your specific requirements

10.3 Data Accuracy

While we strive to maintain accurate figure data, we do not guarantee the accuracy, completeness, or timeliness of any information in our database. Users should verify important details independently.

10.4 Third-Party Content

The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party sites.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTCOLLECTOR AND ITS OWNER, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Cost of substitute services
• Any damages arising from use of the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless BotCollector and its owner, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any rights of another party

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles.

13.2 Informal Resolution

Before filing a formal claim, you agree to try to resolve any dispute informally by contacting us at privacy@botcollector.app. We will attempt to resolve the dispute within 60 days.

13.3 Venue

Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Georgia, USA, and you consent to the personal jurisdiction of such courts.

13.4 Class Action Waiver

YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

14. Termination

14.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

• Your account enters a 30-day recovery period
• After 30 days, your data is permanently deleted
• Any active subscription will be cancelled (no refund for current period)
• You can cancel the deletion by logging in during the recovery period

14.2 Termination by Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Prolonged inactivity (with notice)
• Request by law enforcement
• Discontinuation of the Service

14.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BotCollector regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, government actions, or internet failures.

15.6 Headings

Section headings are for convenience only and have no legal effect.
